“Whoever assaults, kidnaps, or murders, or makes an attempt or conspires to kidnap or homicide, or threatens to assault, kidnap or homicide a member of the fast household of a United States official…with intent to impede, intimidate, or intervene with such official.…..whereas engaged within the efficiency of official duties, or with intent to retaliate towards such official…on account of the efficiency of official duties, shall be punished as supplied in subsection (b).”

Title 18, United States Code, Part 1201(a) and 1201(a)(5), in related half states: “Whoever unlawfully seizes, confines, inveigles, decoys, kidnaps, abducts or carries away and holds for ransom or reward or in any other case any particular person, besides within the case of a minor or by the father or mother thereof, when (5) the particular person is amongst these officers and workers described in part 1114 of this title and any such act towards the particular person is finished whereas the particular person is engaged in, or on account of, the efficiency of official duties, shall be punished…” Additional, in related half, Title 18 U.S.C. 1201(d) states: “Whoever makes an attempt to violate subsection (1) shall be punished by imprisonment for no more than twenty years.”

On October 28, 2022, at 2:23 a.m., San Francisco Dispatch acquired a 9-1-1 name from Paul Pelosi (“Pelosi”) positioned on the Pelosi residence in San Francisco, California. Pelosi acknowledged phrases to the impact of there’s a male within the dwelling and that the male goes to attend for Pelosi’s spouse. Pelosi additional conveyed that he doesn’t know who the male is. At 2:31 a.m., San Francisco Police Division (“SFPD”) Officer Colby Wilmes responded to the Pelosi residence, California and knocked on the entrance door. When the door was opened, Pelosi and DEPAPE had been each holding a hammer with one hand and DEPAPE had his different hand holding onto Pelosi’s forearm. Pelosi greeted the officers. The officers requested them what was occurring. DEPAPE responded that the whole lot was good. Officers then requested Pelosi and DEPAPE to drop the hammer.
